What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Probably not. No-one except you, your legal teams and the judge see the content of the Petition. Contesting is expensive and takes time. You can say that you don''t agree with the contents of the statement but that you agree to the divorce in your response.

It will make no difference to the settlement at all. The only things that do are really heinous things like proven violence that has permanently disabled her.

best wishes,
Sadie

Gambling can affect a financial settlement if the respondent has been reckless with the joint assets. Child abuse can affect the outcome of children proceedings. Generally, the conduct cited in the Petition cannot usually be brought forward to any other proceedings unless there is a casual link.
