What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My wife left me recently after just 12 months of marriage. She was an alcoholic and it has been one of the most difficult relationships I have ever had.
She left just one day before she went into rehab with out even telling me
She came into the marriage with nothing as I have my own house.
I am not sure what the procedure is but a divorce is inevitable - I am not sure what I have to do and more importantly what are the financial implications. Just want this all behind me as quick as possible. Given the circumstances I don''t think she will be awkward.
She has the marriage certificate - will I need that ?
Any advice would be really appreciated.

Welcome. Short marriage (with no previous cohabitation?), no children, you will both go out with what you brought in.

Yes you will need the marriage cert or a certified copy, if you need a copy its not a problem.

The divorce itself is just a heap of application forms, they can be tricky and the terminology is far from straight forward, all the forms are in the wiki library.

Do you have any children with this lady?, if not it makes the money side much easier to sort out generally.

To tie up the money side you need a Consent Order which must be prepared by a solicitor, to do this though you need an agreement with the lady, do you have one?.

No children involved fortunatly. In terms of agreement she says she wants to go quietly so I am assuming she will not be challenging anything.
Not sure what she can try and get out of me though ?

You might have to offer up some token go away money but before you do that I''d suggest that you tell her how much a divorce costs (the wiki service advetised in the right hand column is the cheapest you''ll get and you have to add the court costs to that) and simply offer to pay for it.
