What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

My wife has admitted adultery to her solicitor, who wrote to me some weeks ago saying that my wife is willing to admit to this and will sign an admission statement providing no third parties are named. However I have decided to Petition on the grounds of unreasonable behaviour in case it becomes more of a problem when proceedings commence, plus I was advised not to name the third party involved on a previous post. I will be grateful if anyone can advise if the following wording and reasons would be ok.
I. On the ? of November the Petitioner came home from work to find that the respondent had left him. The respondent did not let the petitioner know that there was any problems within the marriage.
II. On the ? of November the petitioner made a journey of 178 miles to try and find out what the problems were that made the respondent leave the marital home. The respondent did not want to talk and totally ignored the petitioner for a meeting which lasted twenty minutes.
III. It has come to the attention of the petitioner that the respondent has been making comments about the petitioner on a social networking site
IV. It has come to the attention of the petitioner that the respondent has posted inappropriate images of herself and making suggestive comments to other men on a social networking site.
V. The respondent has conducted an inappropriate relationship with another man who the petitioner does not care to name in this petition
VI. The petitioner believes the respondent has now committed the act of adultery as she has indicated to her solicitor that she is willing to sign an admission statement to this.

Its really something the solicitor should write.

You can`t use UB and adultery so take the last bit out.

Start it with the marriage has irrevocably broken down.

End it with communication has ended and you can no longer reasonably be expected to live with the respondent.

Hi Dukey, thanks for the quick response, I was hoping to try and keep costs down to a minimal so really thought about doing it all myself. However I have considered using the Wiki service as I have a busy lifestyle between work and other projects. I also think I could be in for the long haul as I can''t see her agreeing to me not wanting to pay off her debt, as my liabilities are more than hers and she is getting Legal Aid. If I go through the Wiki service would they require her sols letters and would it still be ok to mention she is in an inappropriate relationship.

If you use the wiki service they won''t need the solicitors letters, they deal with the divorce the money side if not agreed is another matter.

They will ask you why you think the marriage ended, then it''s for the solicitor to write the reasons bit, yes they will use the inappropriate relationship bit, give the wiki line a call and see what they can do to help, they are open today.
