I moved out of the FMH on 21st March 2012. Stbx has changed the locks in the last week. What are my rights of access? I still have property in the house, my middle daughter still partly lives there but he hasn''t given her a key, and the youngest has basically been excluded from the house.

It is a joint mortgage and I am renting a house of my own because he would not move and was mentally abusing our youngest (15).

Can I phone the house insurance people (joint policy still) and say I have lost my keys :)

My advice is

(a) Write a polite but firm letter and keep a copy of it, send it by recorded delivery, saying that you would like to make an appointment for access to collect your possessions.
(b) Do not attempt to force entry. By all means do it by agreement, but if agreement is not forthcoming you need a Court order.
(c) If he won''t allow you access, apply for a Court order, which you would almost certainty get.
(d) I''d advise having someone with you when you collect the stuff.
