What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Under current CSA rules when children finish school in June CM is paid until CB finishes in the September. As far as I''m aware the CSA charges don''t apply yet and the CSA aim to deal with cases in 12 weeks.

Thanks Fiona,

I''m aware that CM would still be payable until September if we were using CSA I just wasn''t sure if they would take it on as a new case or would take the approach that as the person I was applying for was an adult and not in full time non-advanced education they didn''t count as a qualifying child? If its going to take 12 weeks though it will be September and all over before it starts anyway!

Ex has always paid CM from day one it''s just that it is ending sooner than I budgetted for.

Looks like it will be a summer with no money!

As I understand it in the circumstances you describe they would not count as a qualifying child.

The application form needs name and address of school or college and details of their course.

If they have finished a course and are no longer attending then they wont qualify. However CSA make it up as they go along so you might find that they do complete an assessment but then the NRP appeals the decision and you have to pay the money back.

Good luck if you do apply.

As far as I''m aware you fill in the course and the name of the school where children are registered and children are still on the school''s register until after the result of the exams.

Yep CSA paid until September prior to uni along with CB. Apply now.

CSA took less than a month to sort my claim out.

Just to offer an alternative point of view, you haven''t said how long for, but this Dad agreed to keep paying you privately over and above the rate the CSA said he had to pay.............

Maybe he isnt dead unreasonable and would listen if you said to him that you would find it hard because of when you thought it would end?

Results are out before term finishes though so I would have thought that if a new application were made after the school year had finished then they can''t be deemed to be attending something they have left.

Obviously it is different for cases that are already open as the rule is they stay open until the first September after leaving school.
