What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Nisi is tommoro; i understand he is going to court to contest costs...

We have been seperated nearly one year and i still have all his belongings. I have asked him to collect. He claims he has nowhere to put them. My sol has written back stating that he can either store in the 2 properties he owns, or pay for storage.

....i suspect he will refuse. If that were to happen, can i legally give him a deaddline and say if not i will get rid of his property? getting mighty fed up

Legally? Well, yes you can say what you like.

Technically you shouldn''t throw his stuff away. But if you do, unless there''s some Ming vases or undiscovered Picasso''s in there, it wouldn''t be worth his while taking you to court for the value. Items are valued at second hand value and so the costs of taking you to court is higher than the actual value - not worth it.

What I would do is this. Write to him, and give 3 dates and times that you are available for him to collect his stuff. If he is not available on any of those days then he can suggest an alternative. Say that if he fails to arrange a day or fails to respond within 14 days, the items will be put in the drive on -DATE-. If he does not collect them then the bin men will.

Been away and just come back to a letter from his sol saying i am being unreasonable (after waiting 10months for him to move his stuff!) and if i do dispose of his stuff they will advise him to sue me - unlike me,he''s on legal aid so cost doesnt matter to him.
Obv it long w/end. Does anyone know are there other options open to me. Seems ridiculus that he can continue this passive agressive behavious ad nauseum

Hi CP

Do you have a garage or a shed??? You could say that all his stuff has even stored in there for him to collect at leisure.

Mine had the nerve to ask me to sort out and keep the stuff he might like when he came and collected some belongings 18 months ago.
Well...seeing as most were never worn I didn''t think he needed any so sold them to needier persons at a car boot sale. One guy was delighted with his bag full of Timberland clothing and I was disappointed I didn''t make a few more euros as I forget the shoes!
nothing delighted me more than selling his clapped out BMW (my name on papers) to a scrapper for 50 Euros...only sad because I forgot to get a photo of it being carted away on the back of a pick-up truck.
Fair do''s for 15 years of deception and wasting my life ;)
