What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Help please??

Here goes!

My husband and I got married in 2004. We separated in 2008. I left him. Things got too much for me. He had 4 children and I had fertility problems so things were hard.

I have no contact with him or the children. They are biologically not my children.

I am working full-time and don''t earn much after paying for my bills and food. Last I knew, 3 years ago, he wasn''t working. So he filed for divorce on grounds of unreasonable behaviour which I accepted because I wanted to divorce him and there was no adultery committed on either side.

Anyway, he filed for divorce, the court lost the papers, I eventually got a copy to sign (1.5 years later!!) I signed and sent back to the court. They then sent the papers to my husband to sign and he refused. I''m not sure why he refused but he did. We haven''t spoken since I walked out apart from to discuss the divorce which we both agreed needed to happen.

I cannot afford to pay for a lengthy divorce but I''m unsure he will agree to sign the papers and I don''t want to waste what little money I have!

Can someone please give me some advice on what I can do? I''m in no rush to get married again or anyhting but I do want to divorce.

Thank you!!

So he started proceedings then stopped, how far did it get, do you have the Decree Nisi?.

Thanks for replying. No decree Nisi. He started proceedings then refused to sign the last papers.

You apply to court and ask the Petition as it was then is "dismissed for want of prosecution" then you can make your own application for divorce.

But I''m still wasting my money for re-applying if he doesn''t sign the papers. Right?

No even if he refuses you have him served and then the divorce goes ahead regardless yes it''s more complictated and it takes longer but it can be done, this site offers the full service for those who won''t play ball for £480.
