What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Does it matter who starts the divorce..

In 2 days i will of been separated 2 yrs.
We have both agreed we will file for divorce then.
He said he will be self-repping and i was going to use wiki.
I was wondering will it make any difference who starts it.
He wants to start straight away.
I want to take my son on holiday(as he hasn''t had a holiday in 4 yrs) he is just finishing his GCSE''s and it will be cheaper while the other kids are still in school and the only time i would be able to afford it.
I would still have the divorce money but not the £340.
Am i right in thinking he will have to pay the £340 if he starts it.

Will i lose out by doing this or does it not matter who starts it.

Who ever files the Petition pays the court fee''s. Will he be claiming costs against you? In my opinion i do not think it matters who starts a divorce especially when its after 2 years.

Setting aside who pays. The difference it makes is who controls the timescales for the divorce.
