Hi , I was expected to have my money from the divorce settlement by friday the 8th . I have heard nothing . I have just phoned the mortgage company and the balance is still the same. My husband told the judge he was borrowing the money from another mortgage company and would be ending this mortgage with our bank . Checking the balance today means he has not borrowed from our bank on the existing mortgage or cancelled it with them . It says on the court forms I should surrender all legal and beneficial interest in the property with full title guarantee subject to the mortgage secured theron in favour of our bank . Should I have done this by now then . I havnt got the money yet so should I get my name taken off the mortgage yet. Teresa
This should be dealt with like an ordinary conveyancing transaction. You should have been sent a transfer to approve and sign. His solicitor should hold it until the money has been sent to you and only then does it get sent to the land registry. If none of this has happened, something has gone wrong.
HI ,THANKYOU FOR YOUR REPLY . I SENT THE LAND REGISTRY FORMS TO HIS SOLICITOR AFTER I GOT THEM BACK FROM THE LAND REGISTRY ,SAYING THAT MY EX HAD TO SIGN THEM AS WELL ,AND PROVIDE PHOTO ID. I GOT A LETTER FROM THE MORTGAGE COMPANY SAYING I CANT REMOVE MY NAME FROM THE MORTGAGE . THAT MY EX HAS TO GO INTO A BRANCH AND DO THAT . I WROTE A LETTER TO HIS SOLICITOR DEMANDING TO KNOW WHAT IS GOING ON AS THE 56 DAYS THE JUDGE SET IS UP . I ALSO SENT A COPY TO THE COURT SO THEY KNOW WHAT IS GOING ON . I AM WAITING TO HEAR BACK .
