What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Sorry this maybe a stupid question but do you both have to have a marriage certificate to divorce.

My H has just told my daughter to tell me he wants it to start the divorce.
I would happily give it, if only he needs it but if we both do why would i hand it over only to have to pay to get another.

Thank you.

You keep hold of it, tell him to get a copy. He can order one off the gov web site.

Only the person filing for divorce needs the marriage certificate. It goes to court with the papers and you never see it again.

Best wishes,
Sadie

Hi Nanny,

My solicitor has asked for mine to start divorce proceedings as i''m the Petitioner.
They are fairly easy to get hold of though so your stbx shouldnt have any problem getting hold of a copy!

Well - when my husband left 4 months ago to live with OW, he did not take the certificate and I have put it in a safe place. I am 99% sure he will not remember the date of our marriage other than it was in the summer! Can he get a copy? I hope not as the status quo suits me in the meantime.

Thanks everyone!

iusedtolovehim i moved mine to a safe place when he left and i am having trouble finding it now, should of left it where it was because he wasn''t interested in it till today.

I have had a lovely 2 yrs break before he has finally acknowledged we were ever married and he wants it all this over with.I feel a lot stronger to cope with it now.

And yes he can get a copy any time he likes.
(if he remembers the date)
