What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Good morning all,
Can anyone tell me please, when a person is free to re-marry after the Decree Nisi ? Do you have to wait for the Absolute ? I am under the impression that divorce is not final until the Absolute, and if married between nisi and absolute is that classed as bigamy ?

The divorce is not complete until the Absolute. If you are thinking of remarrying bear in mind that the Absolute may not be granted u.til finances are sorted. If no application for financial settlement has bee made, there is also the remarriage trap bar on application to beware of.

Financial settlement was made in March of this year and now I am about to apply for the Absolute. Could the Absolute be applied for by my husband ( who I am divorcing ) and would I have been informed of this ? We had the Nisi May 2010,and I now have suspicions he may have already married his girlfriend, not in this country but in the Middle East more than a year ago !! If I find out this is the case, what can I do ? Any advice appreciated.

Apply for your Absolute. Let him deal with his remarriage issues himself, there''s no point in you getting involved.
