What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

what should i do in next step?

I will tell a little bit more about my marriage.

My husband and i got married for 5 years. He never introduced me to his family. He always come out with the reason why he could not do it.we din''t have any kids. he dosen''t want to have sex with me in last couple years but he likes to look as porn website.

I have seen his note in his office, He want to get divorce from me soon. the end of this July our new house will be ready for us to move in. that house is 5 minutes walk from his parents houus. So i think he will sent me a divorce by then, because he probably doesn''t want to introduce me to his family. And in his note said '' he want a new gf there.''

I need everybody advice .what should i do.

Should i waiting for him to sent me a divorce or should i act first by talking to CAB?

Hi Saengdaed,

Are you eligible for legal aid? Are you looking to appoint a solicitor or try and do it yourself?

I''m not sure how much help CAB would be from a legal point of view. Your best bet would be to ring wikivorce and talk it through with them. They will know all the legal points you will want addressing and advise you on how best to continue.

All the best x

Sorry to hear your issues, and agree with previous replier ( sorry, STILL didn''t take in your name, j something something? I AM old!!! CAB is a possibility but you need expert legal advice and they really aren''t geared up for it, so why not do as previous lady suggest and phone these people? I haven''t yet, but may do. My first day too on here, and I wish you all the best.

Filing papers for a divorce costs £340; I think filing theabsolute is another £45. They are reasonably easy to fill in but if English isn''t your first language it might be a good idea to use a solictor - you will see in the right hand column that Wiki can do this for you for £179 (plus the court fees).

With a short marriage and no children you are likely to be looking at a fairly simple financial settlement, both taking out what you put in.

If you start the divorce proceedings it gives you more control but you need to talk it through with your husband to make sure that everything is straightforward. If you both agree you could go for the full divorce and financial settlement package for £279 plus court fees.

Thank you pixy, jslgb, and bereft. I might need a solicitor as you advice but should I talk to my husband first before I contact to the solicitor? He used to do a pre-nup and let me sign for it but by that time I didn''t know was it what. He lied to me that it was a business staff. My English wasn''t very good by that time.

I found out later the detail inside he would not give me any thing. I am a British citizen now.

He is an accountant and also dealing with legal staff all the time. I a bit scary. I don''t want to make any mistake any more

sounds like you should get some legal advice - you need to speak with your husband before you file but perhaps you need more information about your rights beforehand.

I suspect that a pre nup signed by someone whose English was not good is unlikely to be valid but you would need a legal opinion to be sure.

I would personally speak to a solicitor or get some legal advice before talking to your husband about it. Then you will know where you stand.
