What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I don''t know anything about the law and squatters but I don''t think it''s as simple as that. I am pretty sure that you can get squatters out of your home extremely fast - it''s ony difficult when the property is empty.

Best wishes,
Sadie

As has been said it''s not your home, yes your part owner but it''s not your home, to try and move back in will probably call the police, and then hello none molest order.

Hi Dukey

Thanks for the response, does it make no difference that we have a Decree Absolute and the Clean Break order indicates that FMH is to be sold and proceeds divided. Is this now just a biz arrangement till the FMH is sold

Thanks

The aim of the Absolute is to show that you should no longer have to live together, the Clean Break is to separate you both once and for all in terms of financial claims that could be made, you have both, if you try and move back in you will only end up in a world of trouble unless your ex wife were to agree.

Yes, that reduces your chances of being allowed back into the house from "almost zero" to "zero".

The death nell is what Fiona had to say regarding article eight of the human rights act, it kills off the idea alone.
