What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I have spoken with a solicitor acting for my wife in divorce proceedings after being concerned that the box for maintenance pending suit is ticked, the solicitor says their always ticks it but nothing happens.

Is that right?.

The above is for a none wiki member, as i understand it you only tick MPS if you actually want the hearing.

From what I understand is is common practice to tick all the boxes even if you don''t want to apply?

oops wrong form, that''s the boxes for the petition.... That''s why I''m not a lawyer and rely on wikki!!!!

Sorry:(

Erm you don`t tick all the box`s in the divorce application either, you leave the MPS uncrossed :)

It seems some solicitors do tick them all, why I don''t know, I wouldn''t worry they usually withdraw the claims at Nisi stage.
