What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I''m self repping but have in the past had a solicitor.

Do I need to complete form H with my past solicitors fees or, as I am now self repping is this not needed. I have self repped since submitting my own Form A.

Also where can i get form H if need be?

Thanks

Form H is in the wiki library under forms

Yup you should complete it if you have costs, but not costs from the actual divorce just those born from trying to agree the money side of it all.

okay so all my costs are upto the point of getting my Nisi, and then some advice as to how to then act for myself thereafter...

So I assume i don''t complete the form ..

Maybe I''ll take it and ask the judge?

That''s not quite correct. The date of the Decree Nisi is irrelevant when completing a Form H as the Form H should specifically exclude the costs in dealing with the divorce (the process of dissolving the marriage). the form should only detail costs incurred in dealing with the finances.

As you are acting in person, the Form H is largely irrelevant unless you have outstanding legal fees (incurred in dealing with the finances).

Thanks - The only solicitor cost I have had since personally submitting form A is a half hour telephone conversation with my "old" solcitor.

I suspose I should note this down? Where on the form?

The costs incurred in relation to financial issues *prior* to issue should also be included.

Pre issue costs should go in the right hand column in box 1, any pre issue disbursements should go in box 3.

Post issue costs should go in the right hand column in box 8 and disbursements (such as the court issue fee) should go in box 10.

If counsel''s fees have been incurred these need to be added too.

Bring the totals of the sections through to the front page and insert how much has been paid to date.
