What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Thanks everyone! you''ve helped put my mind at rest! Just one last thing....how many months of bank statements do I need to send with my form & can I blank out the main bit & just show the end total of each month? I don''t really want him to see the full statement as I''m sure he will be showing everyone else. This is going to sound really stupid but I walked out (on my own free will) with nothing & left him with everything which I think may be down to me feeling guilty. We didn''t have a joint bank account, everything we bought was paid 50/50 & we lived in rented accommodation. I really thought that it would be straightforward what was his is his & mine is mine!

None, you don`t send any paperwork with form D81, unlike form E D81 is not evidential.

The court does not require any statements. The solicitor can ask for whatever they like. It doesn''t mean you have to provide them.

The solicitor can ask for anything they like, court don`t, this is a mutual agreement so court don`t require proof, some solicitors ask for statements some don`t.

The key though is your ex, are they happy with the agreement, if they are don`t allow solicitors to stand in the way, when my CO went through me and the ex knew what each other had so i made sure my solicitor knew not to rock the boat.
