Hi was wondering if someone can help I am currently getting divorced by my wife and she is requesting alimony in monthly spousal payments a lump sum and me paying her court fees. She is claiming legal aid as am I because I am on extremly low income 207 per week and pay 40.00 child support every week for a child with her and a child from a previous relationship via CSA. She did not work when I met her and has 3 other children to another man she recieves income support,child tax credits,council tax benefit,housing benefit and child benefit, will she be entitled to alimony because I also need to pay my bills in my home. we were married for 6 years total and during that time i provided for her and her three eldest children to her previous partner.

If you earn £207 per week your wife has no chance whatsoever in asking for spousal maintenance, £500 per week plus then it becomes an issue, but not on your income.

thank you i''m just worried because on the last page of the court docs she has said she wants costs of divorce, a lump sum and spousal maintainance. i am already paying for my child through the CSA which she is not happy about as she recieves none of it due to fact she is on income support she wanted £250.00 per month which i cannot afford i''m just really worried that a judge will give her lifetime spousal maintainance when i just wanna get on with my life!

If your talking about the last page of the divorce application headed prayer, its standard practice to tick all the box`s bar the maintenance pending suit.

It does not mean she is asking for it all nor does it mean she would get it.

No chance you will pay SM on your income.

Don''t worry it''s just a standard practice. You don''t have to pay unless a judge says so. And on your income no judge would ever say so.
