hi need some advice asap....at the moment im on legal aid..and was trying to get help with cost for court case...re settlement in divorce...the legal service commission are going to close my application down next fri...unless i can supply details to a certain bank account held in joint names with my stbx...my problem is that i have no access to this account...my ex set it up in april 2010 and i didnt know it even exsisited till mediation last year....i have explained this all to them but they wont accept it...i have been to the bank but they say my husband has all the details etc..he has been asked to provide details to the account by my solicitor and his but nothing....his solicitor told mine that he has gone very quiet lately not replying to letters calls etc....my ex has done everything to hold things up right from the start....and will try to effect .hurt me whatever way he can....if i could get hold of the money it would help as i could pay my own cost without needing legal aid..but again this wont be easy he wont rush anything esp if im to gain from it....the amount in question is 25k half would be mine(if when i get it)...my ex is on 77k a year im on 12k...and totally broke while hes been hiding money away....im on tablets for depression and i really dont know which way to turn...HELP....:(:(:(

Sorry you are having such a hard time. I have similar problems like most on wiki.

Just in relation to your account held in joint names..... My stbx froze ours recently & arranged all statements to go his relatives address? Anyway as my name was on this joint account the bank was able to give me statements of account when I explained marital situation. So you should be able to get these for Lsc.

I''m on legal aid also & having many problems also with stbx hiding funds etc.

hi redwine47...thanks for reply...have been to bank but they said i cant access account unless i have all details which i dont...sorry to hear your going throu the same....these blokes really know how to get to us eh :(

Go into the bank again. Take with you passport, drivers licence, utility bills - lots of documentary evidence of who you are. then ask them to enact the procedure for locating lost accounts.

People loose track of accounts for various reasons and banks can search their records using your name address, even past addresses (so long as you have proof you are that person who used to live there)

Don''t be put off. I would also ask for a stop to be placed on the account so that any money within it can''t be accessed. OR make it that both signatories have to be present for withdrawals to be made. make sure you tell them this is a legal matter.

Simply telling you your husband has the details is unacceptable and not what you were asking of them.

Are you sure the account exists..?.. I. don''t understand how ur ex was able to open an account without your Signature or ID. If this account does exist and has your name on it the bank have to give you details. Or at least be able to tell you if an account has been opened with your joint names!



I would go back to them with details you already have and clarify if an account exists. It may be in ur OH name only, therefore they don''t have to provide details to you personally. If in his name it shoulnt affect ur legal aid
