What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Have heard that my ex has now proposed to his GF. I am surprisingly ok with this...
He has known her for a year and we are still not divorced...thanks to his stalling, challenging and generally being obstructive every inch of the way. We have Decree Nisi (which he opposed in court attended with gf!), mediation failed and now trying to negotiate. (Actually his negotiation is "I want this (50% equity) and if I dont get it take me to court".
Do you think now (finally) we can get on with divorce?! Blimey...I bloody hope so!

I think it''s important for you to realise that the process of divorce and sorting out the financial side of things are largely separate. It is possible to get a divorce first and sort out the financials later, although in an ideal world the two processes should run in tandem.

He''ll probably want to get the divorce over with a.s.a.p. if he is engaged. If he re-marries, then that is very likely to have an effect on the financial settlement
