Hi all,

I am the applicant in an Ancillary Relief case. My Decree Nisi was declared Absolute last week becsuse my ex-wife raised no objection.

My ex has been difficult throughout. Her form E was incomplete, she did not disclose the existence of 2 joint bank accounts, and it was sent to me unsigned and undated on an out of date form. There was no supporting documentation at all.

Yesterday was the deadline for filing Form G. I filed mine at Court and with her, together with a questionnaire asking for all the missing documentation. I have received nothing from her.

What should I do now? Should I write to the Court to tell them the Form G has not been received? What will happen if she doesn''t send it at all?

You need to raise the issue on your questionnaire and leave it for the judge to deal with at FDA.

Thanks, but I''ve already filed the questionnaire. I have listed the things that were wrong with the form E, but not the fact that the Form G has not been sent to me...

Form G is not appropriate, you don`t even have the basic disclosure so there is no way you could even think about using FDA as FDR.

Thanks for your advice Dukey - that''s exactly what happened - she filed a Form G requesting an adjournment on the grounds of ill health then didn''t turn up. The Judge ordered her to provide answers to my questions and copies of her bank statements etc. I am now concerned about what to do if she doesn''t comply with the order. The FDR is scheduled for 21 Sept, but I don''t expect her to turn upo to that either...

Any advice would be gratefully received.
