What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Cab confirmed that I can get Legal Help. My appointment in Aug with Solicitor to apply for this.

I understand that this is ''public funding''. Husband said he would pay for the divorce and is a ''''private client'''' who has a Solicitor.

My question is and Ive read this somewhere:

That my legal help costs will be changed and be charged at the rate of ''private clients'''' cost when divorce is finalised and will then be paid from the Sale of property or other assets available.

There are two versions of legal aid,

Legal help, you don`t pay this back and the rates are capped.

Full legal aid, not all who qualify for legal help qualify for a full funding certificate, you need a full cert for applications for a financial order, what was called Ancillary Relief.

If the statutory charge applies then its only a loan and must be payed back.

Legal aid rates are capped and its quite uncommon for them to raise to "fee earner" rates".

Thx Dukey, now I''ll just have to listen carefully when they mention ''''aid'''' or ''''help''''.

I''m Afrikaans speaking and all these terms might be common sence to others but I''m learning quickly..thats why my comments or questions might sound so different when in English. lol.
