Cant leave my only income is £298 DLA, did try Legal help, but they are taking their time. I am so anti benifits but will need help in other ways than sols for divorce.

I will Selfrep with help from wikivorce available. Just reading more info on Injunctions etc as I know its gonna get ugly, as he becomes very aggressive.He might leave and not pay mortgage, etc.

Will Petition him soon. Just getting all my facts ready.

Amefbi. I am just reading your post and appauled at your treatment. you state that you are on DLA and the amount suggests that it is high rate?

Going on my personal circumstances which are somewhat similar to your own although I was subjected to actual domestic violence and hospital admissions because of the same, I contacted the DWP and claimed that we were living separately in the house and had been for 3/4 years. I was given pension credit as a single person. I am sure that this should apply in your situation, either pension credit or income support and if you are on high rate dla the basic rate does mount up with the disability supplements. I also contacted the council regarding council tax. The council were very helpful and decided that we were both liable for council tax. Mine was nil and he had to pay full for a single person. He eventually left after being served with a non mol on an ex parte basis with occupation order pending. The stress is dreadful I know, I am still in the throw''s of a divorce and it is not going smoothly and it does take a toll on ones health, but hang on in there I am sure there is light at the end of the tunnel, at least that is what I am clinging on to.:silly:

I did claim E&A in 2009 and they paid my pension credits?I never received money.And DLA then about £400, High Mobility, med care. I was trying to get income so I could leave and support myself. DLA time limit and denied for next yr, Did appeal was reinstated but at £298, without medical, Im am busy with them and did sent letter about this divorce 2mths ago,just received letter they are still busy. I did apply with E&S in May for special circumstances, living in seperate bedrooms etc, never heard anything gave them call 2 weeks ago, they will follow-up..I have been trying to get away and need money to support myself.
Dealing with my illness and getting more restricted in my movements, and dealing with benifits that I know nothing about, is very stressfull, and I sat for weeks trying to file these docs..and then dealing with this man??...but I found this site and know I dont have to feel alone en worthless and I can get help with my situation..it might take met bit longer but I will get there.
He does pay all the household bills currently...but its getting ''''heated'''' again when I said I am going on with divorce then. I want to get a lock on my bedroom door now..thanx for all these replies, all this knowledge and imput gave me confidence again

You need to get an appointment with a Welfare Rights advisor to speak to DWP upon your behalf and also, is there not an advocacy service in your particular area?

Another thought that might help. Have you considered Womensaid? They are very very helpful. I spent a couple months in a refuge and they sorted me out solicitor, benfits, place to live etc although I was able to come home eventually and he had to leave. What you are experiencing is domestic violence and control. The womens aid only use solicitors who excess in cases of domestic violence so you can change solicitors. Look them up online, they have centres you can go to or they will meet you away from home or call you when it is safe. It''s hard I know but once you start it is amazing the help and support that is available.

Thx for this, I did surf the web some time ago, but changed my mind again,when I can hardly walk that day, I open my frontdoor and my dog runs to park opposite road,and HB works long hours and some weekends. I used my savings adapted my house for my needs. But yes its an option.
Just received that dreaded long form for DLA today.I cant deal with this again, will have to see CAB or Welfare rights to help me. People defrauding the benifit system has made it difficult for people that really need this.Paying for my prescriptions is £45pm, did buy precard in feb, that helps.
I believe he will be moving soon as his phone bill shows many estate agents numbers, he travels 30miles to work.
I am just very tired now, have been reading post day and night on wiki and am so grateful for everybody''s support.
