A friend of mine is going through a divorce. She is the respondent. It''s on the grounds of 5 years separation. The Nisi has been applied for. They want to ''do it themselves'' to save money. Her stbx has appointed a solicitor. They have verbally agreed that they want a Clean Break as when they split 5 years ago they divided up the assets. No children involved.
What is the best way of securing a Clean Break? Is it as simple as drafting an agreement and getting it witnessed by a solicitor? Is there a standard form?
The solicitor will draft a Consent Order which provides the actual Clean Break, in others words it''s the order that is the clean break, they tell the solicitor what they have agreed and the solicitor writes it up.
Be careful with costs though, this site provides a solicitor Clean Break service for £139, it''s worth checking to see what the solicitor intends to charge.
