What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

the divorce and the finances are two separate issues.

you can get divorced prior to sorting finances but you cannot finalise financial with Consent Order without getting the Decree Nisi.

But there is no reason why the two cannot run side by side

It appears they are running side by side. I start mediation next week and my soliciotr has seen the divorce papers, but these haven''t been signed my my wife yet and haven''t been sent to court (10weeks after she started)

She informs me that she will hold the divorce for 3months but wont change her mind - is there anything she can gain by doing this? or could it be coz she has doubts?

Should the finances / marital home, etc - be done between the decree midi and the Decree Absolute.

Yes ideally finances and children should''ve agreed between the Nisi and Absolute.
I have no idea why she would be holding it up.

It seems strange to me that we are sorting the children n finances without even being served a divorce petition.
