What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

2 months away from Nisi have just found out my wife and the fella who now lives with her in our house have had a child.

My amateur solicitor friends (of which I have many ) are split to whether this is good, bad or indifferent to my case.

Obviously I''ll tell my brief on Monday but my gut feeling is this is bad, very bad. She has ignored every step of the divorce process so far.

Has she declared that she is co-habiting?

Declared to whom?

She moved this bloke in 2 weeks after I left but I wasn''t aware. She was also pregnant when I left although I hadn''t slept with her for a year and had an abortion.

I mean has she declared regarding the separation and divorce that she is co-habiting with another man? Has she been honest about that part of the the breakdown of the relationship? Also how long have you been separated and where do you both live?

Up until the point to agreeing with the divorce she had made no mention of co-habitating. She wanted unreasonable behaviour so I agreed. She has not taken part in the process since, no response to letters, nothing. She lives in marital home, I live in my 4th rented accomodation.

Can you give details of timescales, now long you have been in rented, when you left the marital home, you already stated another moved in weeks later.

What are your financial obligations right now, what are you paying in rent, are you contributing to the house, do you see your children, do you pay for their needs, anything else you think relevent?

How long were your married and ages of both, children,
