hi there, i need some advice......my husband wanted a divorce last october and i stayed in the family home until may this year when i eventually found a rented accomodation. i took on a 6 month lease which my husband paid for to help set me up. mylease is comng to an end and nothign has been sorted yet with regards to finances a year on. we have both filled out financial disclosures, and because there is very little equity in the house, perhaps even negative equity, then my ex wants to keep the house, along with all joint debts and give me £5k settlement, which is disgusting. the house is worth about 310k. i feel like he is pushing me out and giving me a sum which after 7 years of being married is wrong. i have invested a lot in the house, and £5k will never get me another permanent house. with this offer feel that the next step is the court. my ex has applied for anxillery relief? to get this moving forward and i feel that i now need to go back to the house, and live there until a fair judgement is made on what happens to the house. my worry is, can my ex stop me for any reason? or pull any court injunctions out of the bag to prvent me? he is capable of that. we have 2 children together both under 6, and our house is in joint names both mrtgage and house deeds.....i hate the house i rent, i never intended staying here for longer th
the 6 month lease, andfeel as though i need to back in the house now to claim what is due to me.....my solicitor said that his pension alone is worth about £45k for my share, but i know he doesnt have this money......i need help, please.

You need to post more details really for someone to advise but why do you think his offer is disgusting?

The house may be worth £310k but if its in negative equity then its a liability not an asset. If your total assets are less than yor total liabilities then him keeping all the debts might be the best you can hope for. Where is the £5k coming from is it savings?


You may well get a share of his pension but it doesn''t come as cash. You probably wouldn''t actually see the benefit of it until you retire.

Would it really be right to move your children, i assume they are with you, back into the FMH if you aren''t going to be staying there for any length of time?
