What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Been unofficially seperated now for 12 weeks and starting to talk about the legal process
Only problem is that I think the OH is transferring savings (own ) to a 3rd party out of sight
Would I still have a right to claim this money when we come to the legal split of assetts

You could do, under section 37 of the Matrimonial Causes Act 1973 if you can prove, firstly that the transfer was made, and secondly that the transaction was done with the objective of defeating your claims for financial relief.

But I don''t think this is a matter for self reppers. You need legal advice, and some such, advice, now, is recommended.

financial disclosure whether voluntary or through court would require both parties to submit at least 12 months bank statements for all accounts. This should hopefully enable you to determine where money is going.

In my case his 12mths bank statements of this acc stbx Sols has is fine.

But I have his statements from 2009-2011 of transferes of huge amounts into friends accounts ''''hiding'''' the money.

Mine has been planning his exit since late 2008 when he 1st filed for divorce, withdrew and in July this year filed for divorce again, with same Solicitor.

Do I really need a Solicitor if I have all my documents to prove my case.
