What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi

I have been separated from my wife for nearly 2 years. I own two houses in my name alone, my wife moved out of our marital home into the house I used to rent out. For the last two years I have been paying both mortgages. This has crippled any savings I had and in the long term is not viable. But when I speak to the bank about removing my name from the house and putting her name on it they will not allow because she does not earn enough money. I am completely OK for wife to have the house and I pay to help with the mortgage and money for my son. Any help would be appreciated because I can''t seem to see a way out? The plan is to divorcee amicably!

Possibly the easiest way forward would be to remortgage,( different lender!) putting your wife on m/g this time, so that she will also be on Deeds. Might make it easier to divide the assets and let her take m/g on her own, further down the line. Just an idea. I am sure some far more knowledgable Wikis will be along to help later. :)
