What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi
I am Acting in person for finance matters.
My STBX husbands Solicitor sent a list of Possessions and Chattels on August 30 to which I agreed and asked them to collect. To which they advised they will collect, it has taken 1.2 months to set date/time for collection and The items are still packed at FMH.

Today I received another letter stating a list of further personal possesion and chattels will follow that he intends to recover.

Is that normal??
Can a new list of possession and chattels in addition to the one already agreed to, be asked for?

Are they personal possessions or marital possessions that the family used?

Usually there is only one list, what happend did he forget?

Personally I packed up everything that I "saw" as my X''s and put it in the garage for collection, wasn''t trying to be mean just needed to clear thigs as it just brought constant memories and upset.

I then offered a day that he could come and take anything else he thought as his, there were threats that the kids beds would be taken (or half of thus just 1) but luckily this never happened. Although, x did come and help himself to things as required, didn''t bother me but he could of said... Anyway I digress.

How long is the second list, and does it include things that you think are incorrect? If so I would contest it, if not then I would write back stating that this list is the as far as you are concerned the final list, no further lists will be considered and give a date for collection which after 2 weeks items will be suitably disposed of.

You are brave doing the finance side yourself, I am impressed, I would continue to post re the offer etc before you agree, Dukey (hope you dont mind dukey) :)is very good with advice as are many others on here.

Stay strong JJx

Thanks everyone, after spending 10K in 2 months on solicitors for injunctions and undertakings, i decided to take care of child matters and finance myself, and have left divorce to be taken care by solicitors.

I waited for 1.2 months for my STBX husband to pick his stuff, without complaining, and now his solicitor has come saying she will be sending further list, i am aghast.

As I have packed his stuffs already, I feel he is using my kindness for granted. anyway, i intend to use the same wording as Fairly land suggested to his solicitor. Hopefullyy she will get the point.

Thanks

Hi Maisy,

They are mix of personal possession and marital possessions.

His solicitor has used ''Personal possessions'' word for things that belonged to both of us maning ''marital possession''

Can I mention that in the letter to his solicitor?

Write the letter to his sol as Fairylandtime suggested, and put date of collection on it use about 14 days from post of letter, and send recorded. and that this is final list of chattels - by what ever definition, marital or personal - and that you will not offer again to be so amenable if he does not pick up by this date. Time to get tough, Inner, I''m afraid. Hope this helps..

Letter drafted, can anyone check please if its OK? I do not want to sound rude but I want to be polite and stern at the same time to stop stbx husband and his solicitor to take advantage of my kindness.

Dear solicitor,

Re: List of Possession & Chattels

I acknowledge receipt of your “Return of Possessions” letter dated 1st October 2012.

I will refer to your letter “List of Personal Possessions and Chattels..” dated 10th August 2012, attached, which outlines the final list of Possessions and Chattels comprising of 20 items as the ‘Final List’ and no further list will be considered. I am happy to sign and re-send your Final list letter again.

On the Final list of Possessions and Chattels, I agreed to all 24 items except for xxxxxxxxxxxx which was brought jointly.

I propose the collection of the possessions and ‘return of spare house keys and car keys’ to take place on xx October 2012 at xx:xx time. I am willing to accept Mr. xx to pick up possessions and chattels and to return spare house keys and car keys.

I have been extremely understanding and reasonable to wait for more than a month for your client to collect his possessions and chattels and to return the spare house keys and car keys

If spare house keys and car keys are not returned and your client’s possessions and chattels not picked up by xx October 2012, I am afraid then I will not allow your client to take advantage of my generosity and items would be donated to nearby Hospice.

Yours faithfully
