What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi - I''m doing some tieing up of loose ends and need to forward some correspondence to the court for my file.

I''m sending:
1. a copy of a letter with documents required by the court order.

2. Copy of a letter answering his questionnaire also as required by the court order.

3. Copy of a long (!) letter pointing out where he hasn''t answered most of my questions in my questionnaire and enclosing an annotated second copy of my questionnaire and asking 1 further question.

Should I just ask that these be filed in my file or should I be asking them to be filed in a specific place or section?

Thanks. I''m doing all this stuff myself to cut down on the solicitors bill.

Are you talking about a questionnaire and statement of issues?.

Not exactly.

We are nearing our second hearing for finances.

The copy correspondence is either in reply to his questionnaire - which I was handed just before we went into the first hearing. and replies/comments I have sent on his (non) answers to my questionnaire.

Is that clearer?!

Yup

So in answer to his questionnaire head it "schedule of deficiencies", file and serve as always, the court will add it to the existing file, your case number is all that is needed.

Thanks Dukey.

Just to be sure -

I assume I add that for his non-replies ...

Do I add anything to my (on time and fully complete) replies?

thanks - sorry If I''m annoying!

You couldn''t annoy me if you were slapping me with a dead fish.

The schedule of deficiencies is the reply to his lack of answers to your questionnaire.

You reply is, answer to the questionnaire raised by (name) case number, it''s more important he gets this part than court.

Is that a bit clearer?.
