Hi all I’m new to this so please bear with me!
I’m Melissa and I applied for divorce on the grounds of unreasonable behaviour from my (ex) H- in May 2019.

I finally received the paperwork yesterday to tell me the judge refused it because of insufficient evidence.
I am preparing a stronger statement but I am not happy this wasn’t granted. He already signed the paperwork and he accepted the standard statement I wrote.

I was in a horrible marriage and there were incidents of DV- but I don’t want to go down that route. Then the court put a note to say that the amended form (with the evidence!) would be served to the respondent again!!! :evil::S:S:S

I need to amend in red pen and pay £95.
A note has been included to say “ (I) can only apply for it to be able to renew the request for Directions for Trial once the acknowledgement from the respondent has been received” which I find incredibly patronising from the court and again, if I present all the evidence from the police, SS, doctors and work, it just makes me very vulnerable to his behaviour although now I have managed to have a decent co-parenting relationship... where he has been relatively decent to our 8 year old and this will throw it all out of the window again, and he’ll probably refuse to sign it once he sees all the evidence.
Also he doesn’t even live there anymore, he moved out of the house in April 2019 to go and live with a co-worker who he much later on confessed to having an affair with and is his current partner.

What can I do? Any advice most appreciated.

Welcome to Wikivorce but sorry you find yourself here.

To divorce on grounds of unreasonable behaviour you need to cite 5-6 examples in the six months to separation or continuing.

Unreasonable behaviour is behaviour that makes it unreasonable for you continue to be married. It doesn't have to be especially extreme.

If you use the search facility you can find examples used by other wikipeeps.

You don't need to produce reams of evidence unless the divorce is defended. It doesn't sound like it will be.

Alternatively if he is in a new relationship he may agree to the grounds being changed to adultery.

Regardless of how the petition is changed your ex needs an opportunity to respond which is what the court has said albeit in funny legal language.

Thank you for your message. I did send the 4 reasons requested and they were not really anything incredibly nasty or exaggerated... so clearly the judge did not approve it and rejected it and asked for more evidence... 🤷🏻‍♀️🤦🏻‍♀️ So here I am looking for something more beefy to throw in there... so there’s no chance of the judge saying no this time...
