What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Is the house and mortgage in his sole name? If so then yes he probably can.

If it is in join names then no he can't.

The fact they have sent he a letter suggests it is in joint names. Was the letter addressed to both of them or just her?

She should contact lender. If she isn't getting her own copy of all letters relating to the mortgage then she ought to let them know her new address and that going forward each party will need separate correspondence.

Are you sure that the rise hasn't simple been caused by a fixed rate product coming to an end and moving onto variable rate?
