What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi everyone.
My question is my wife and I bought our current home together , we both put equal amounts in for the deposit, if we got a divorce I have no problem with splitting everything 50/50 our savings everything, I am the only one working, I have a step daughter with my wife .
My fear is my wife said she would take half my other house which I bought before I met my wife , she has never even seen the house let alone put a single penny into it . Can she make me sell it for half the money , we will have been married 5 yrs in December.
Thank you for reading

You need to post details of ages, incomes, all assets, length of marriage plus any cohabitation beforehand and children for anyone to comment.

I am 50 my wife now s 47 .
Lived together for 4 yrs in her house .
She sold hers and I sold one of mine and we put almost equal amount into buying our current home .
We have two cars , not much savings but like I said I’m pretty much the sole earner , and I’m happy to split 50/50 .
But it’s my second house I’m concerned about

Are there any children involved?

Why isn't she working?

If you split everything except the second house 50:50 will this rehouse both of you?

My wife has a daughter 12, the father is still around and pays for her private school as he is financially sound,
If we sold our home now we would both walk away with £100k each ,
She likes being at home , does very occasional self employed work ,

Would £100k plus what you could each raise mortgage wise rehouse both of you?

What about other assets such as pensions?

What are your incomes?

How much equity is there in second property?

£100k .Yes it should be plenty to start again.
I have a pension that has been frozen for years and is worth virtually nothing.
My income as self employed can vary between 45k to 60k .
Hers is only the minimum before tax , not that she can’t work she says it’s difficult with school runs ect ,
Second house I would roughly say equity is about 60k .
If I signed the house over to my two brothers ,in enough time! would that stop her claim should the worst happen
