What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi,

Currently at Nisi stage, wife divorcing me even though she is the one committing adultery. Current situation is acrimonious and she is refusing to consent to the sale and fair split of our only asset the house. She moved out with our children and I'm still in the house. mediation has been started but will break down due to her refusal to sell.

The question is if I apply to the courts for a FO will the court rule that the house must be sold and split. I don't care what the split is as long as I break the financial link. She has never paid for the mortgage but is named on mortgage, our time together is nearly 24 years.

She is under the impression that she can stop the house being sold and force me out of the house. This sounds a ridiculous affront to all fairness in life.

Any advice greatly received.

You need to post more details for anyone to comment.

Are there any pensions or anything?

Post details of all assets and incomes.

No pensions or other real assets, she's currently studying and i'm searching for a new contract, no savings due to the current pandemic, it's been a frightful year.
