What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi all,

I had court divorce papers in the post today, I've been named as a co-respondant. The grounds for divorce are adultery. From what I've heard, to file for divorce on the grounds of adultary it needs to have been filed no later than 6 months after they first found out about it. The adultary in question here took place about 5 years ago. So do i need to do anything or can i just throw away the papers because the case is invalid.

Thanks very much!

It's 6 months from the date of discovery of the adultery.

I would not ignore the papers as this will cause more hostility and more cost. That cost is likely to be sought from you if you fail to engage in the court process.

Thanks for your reply.

How would you suggest I continue?

Surely they won't be able to sought costs from me as it is an invalid case.
