I’m not sure if I’m in the correct category, but I received a D81 form from my ex husband, we divorced almost 2 years ago. I haven’t received any documents which state what I am signing and what the agreements are. He put his wages wrong on the form and has also stated that our son lives with both of us which he doesn’t, he lives with me. I have a few questions as i have no idea about these forms

Should there have been any more documents stating what i am agreeing to and what I’m actually signing?
Will it effect child maintenance ? As it took two years for him to agree to pay for his son
Should i get my own solicitor?

He’s being very shady as he keeps saying he just wants me to sign it so he can send it off asap. He doesn’t want me to get my own solicitor “because they’re very expensive” and he’s said a few times that it wont effect CMS. He’s just saying it’s to agree that if either of us come into any money in the future then we can’t take it off each other. But i have no document to prove this is all it is.

Any advice is much appreciated as i have no clue what I’m doing! Thank you

The D81 is a statement of information that goes to court with a Consent Order. You should ask to see the draft order before completing the D81 and returning it.

Anyone who attempts to barr the other party from seeking thier own legal advice is a massive red flag to me. Don't just accept what he's telling you.

A Consent Order shouldn't affect CM as you can approach the CMS at any time to open up case if you haven't already done so. If the CMS aren't involved, check the draft consent order carefully for any mention of CM as he may have tried to sneak in a lower amount each month into the order.

Whenever I ask him to see other documents he tells me this is it and it’s just him protecting his future but surely both parties need to come to some sort of agreement with a D81? But I’ve not agreed to anything and just been handed the form, doesn’t make sense

For there to be a Consent Order, there needs to be full agreement between the parties. You need to see the draft order.

His solicitor is going to be sending the form and hopefully the draft directly to me so I’ll see if they’ve included what I’m actually agreeing to when signing the form

We don’t really have any finances together apart from a loan they we are both paying each month

He told me it’s to prevent me taking any money from him in the future and that’s it
