What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I was briefly married for 3 months and we separated. No kids, no joint accounts and the house was already bought by myself before marriage. She contributed nothing either.

I applied for a annulment in may 2021. The Decree Nisi was granted in September 2021. However it hasn't been pronounced after all this time so I can't move ahead and do the absolute to make it final.

The court is saying it hasn't been pronounced perhaps due to a error and have been unable to escalate it so its just sitting in limbo after all these months. When the nisi was granted in sep 21 , they didn't do the paperwork and file it on the system so it hasn't gone anywhere. So I got no certificate of the Decree Nisi being granted.

What can I do its now Dec 21? I made a official complaint but still nothing has gone anywhere. Every1 I talk to on the phone says sorry for the error but no one seems to be able to do anything. Surely when the nisi was granted it should have been pronounced so 6 weeks later I could have made it absolute

I suggest writing to your MP and ask them to intervene if your attempts are being met with shrugs and a brick wall.

Saying sorry but then not actually doing anything to rectify the error isn't good enough, and is impacting on your life significantly.

Thanks I will look at the mp option. I'm just worried incase the mp doesnt reply back.
do you think nick should apply for a online divorce instead as that way it be a fresh application and can be looked at again, rather than continuing with the annulment?

Your MP has to reply to you as you are a constituent.

In order for a divorce petition to be submitted, you would need to withdraw your current annulment application, which may not be so straightforward as the Nisi has been granted, and you would lose your court fee. The whole process would then have to restart, adding yet further delays.

All the courts need to do is produce the Nisi paperwork...

Yes yr right I don't really want to be waiting longer for a divorce to go through. They just need to pronounce my Decree Nisi. The petition was sent in July for the nisi. And its December now and they havnt done it.

Burys st edmunds is a nightmare to deal with. I asked the case to be escalated as its well over the 45 day limit for processing it that they advise. I have been told by the call centre staff they have ask the admin team to ask a judge to look at it..

Ok so I made a complaint with burys st edmunds court. Last I knew they escalated to judge. I got following reply. Is there anyway I can speed this up???

Application for a Decree Nisi
I'm sorry for the delay in the outcome of your Decree Nisi application. The applicaton was referred to the Legal Advisor for consideraton on the 17 August 2021. Although the file came back from the Legal Advisor on the 8th September 2021 no Order was drawn at that time. I'm sorry until an actual Order is typed up, we shouldn't have advised you that it had been granted. I've spoken to the relevant managers to inform staff of this.
Your case now
The Decree Nisi is yet to be issued. The file had to be referred to a judge for further directions, this was done on the 12 November 2021, and we are currently awaiting the outcome from the judge. I'm sorry as I don't have acces to the case file, I'm unable to provide you with more detailed information as to why it had to be referred on to a judge.
