What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi There
I wondered if anyone had any advice.
I am in the respondent in a divorce, the application was made December 2019 and my ex is refusing to sign the application for the Decree Nisi until the financial orders have been agreed, first court hearing is next month.
I have told him that financial orders cant be official until the Decree Nisi is in place but he fails to listen.

My concern is the unnecessary delays as its been so long already. Is there anything I can do to escalate this via the courts or would it be advisable to put a new petition in where I am the petitioner instead, or would this simply mess things up?

Thanks in advance.

You cannot put in a new petition without getting the existing one dismissed.

You could put this down as an issue and ask the judge at first financial hearing to put in the order that Decree Nisi must be obtained.

Presumably your ex knows that you cannot have a legally binding financial settlement unless you have the Decree Nisi?
