I was married for 26 years and the court granted me indefinite alimony as I was a stay at home mom. I also received shares to a company that we were shareholders of. Now that the company is paying out dividends and my spouse conveniently (he is 62) is no longer working, he is taking me to court to modify or basically do away with paying me alimony. He also received a million dollar inheritance.( I am aware that is not mine.) In my settlement it never stated that if I got any money for the shares I would no longer get alimony! I am from the state of Illinois. I currently am unemployed and although they are adult children, they live with me and also find themselves unemployed. My ex is engaged and she has her own salon and so more money for him. He has only had to pay me for three years thus far! What are your thoughts? Thank you! I do have a lawyer and have already paid 16,000 for all this garbage. S.O.S.

I am afraid that as you are in the US it is very unlikely that anyone on the site can answer your specific question.

What i can tell you is that I imagine there is a similar principle that applies, that is that spousal maintenance (the UK term for alimony) is based on demonstrable need and ability to pay.

So you have to show you need the money as well as showing he has the funds to provide it.

Any variation of spousal maintenance should be based on a change in circumstances since the original order was made.
