I filed in a nullity petition in Aug 2006 for a marriage that took place in Feb 2006 after my husband walked out of the marriage and started living with another woman 2 mths after the marriage .I was made to understand that he was previously married to this woman without a divorce and went ahead into another marriage with me without informing me of the existing marriage.He has refused to acknowlegde the service, 2 yrs gone now that we have seperated,it is more or less that the marriage did not exist at all.It is very difficult for me to prove the previous marriage bcos it took place 9 yrs ogo outside Uk.Now i am planning to change the petition to Divorce instead of Nullity which he has agreed to using Form D11 Based on adultery and unreasonable behaviour.
I want to be very sure if it is OK to change the petition straight away or i should withraw the existing nullity petition and make a fresh petition based on Divorce ground.
I am not planning to appear in court for whatever reason.
Please i need help on how to fill the Form D11 to be able to get the right result without delay and what is likely to be the outcome of the whole process.No children or finance issue is involved.

Form D11 is just a notice of application, why not just go for the divorce if he agrees to it, either adultery, UB or 2 year sep

or issue an amended petition

Just use the existing petition, head it 'amended petition' cross out what no longer applies and put in what now applies.

Courts charge £80 fee for amendements
