What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Went to court to hand submit absolute - granted no problem.

BUT judge and clerk said I could not hand in finanical statement of costs. Judge wrote me a very nice note saying 'civil proceedings rules govern costs in family matters. Petitioner should sign the statement (the one I put in) WHICH SHOULD STRICTLY FOLLOW THE MODEL/PRESCRIBED FORM,

question 1. What is the prescribed form or format. Any examples please

AND SERVE IT ON THE RESPONDENT

question 2. How? Is recorded delivery sufficient. Or do I bailiff him?

TOGEHTER WIH A NOTICE OF COMMENCEMENT OF DETAILED ASSESSENT PROCEEDINGS.

They gave me this form at the court. Think I can do that bit.

question 4. I have minimised my costs by self representing, is it sensible or not to also ask for two days annual leave to be paid back to me, time taken off in taking docs to court, citizens advice etc

RESPONDENT HAS THREE WEEKS TO SERVE HIS POINTS OF DISPUTE. IF HE DOESNT THE PETITIONER CAN SEEK A DEFAULT COSTS CERTIFICATE.

Bit lost can anybody give me guidance, especially on question 1, I dont want it thrown out of court for being the wrong format. Thought I was over the worst but more bloody headwork by the looks of it.

thanks in advance for any help offered

See HMCS website for forms....Ring local County Court and ask them to tell you which form of the site is to be filled in
The Court may send you a copy of the Proceedural Guide for assessing costs in the "Red Book" the Family Court practice

Thanks for reply.

Think I found example/model bill of costs via internet research on CPR on HMCS website. Precedents there as well.

at www.justice.gov.uk/civil/procrules_fin/c...rts43-48.htm#4389662

Annexes right at the bottom of the page have bill of cost examples.

So I copied format, typed it up, send with notice of assessment of detailed assessement filled in, not sure if I got all the fees correct, together with a polite letter saying its in his best interest to settle in full within the 21 days notice or risk incurring liability for the rest of the fees for this process. Absolutely wopping fees, suprised actually.

Hopefully this will scare some sense into him and he will settle.
