my stbx is planning her third holiday abroad since she left 15 months ago , me and the kids havent had one since she left i am stuck with all the debt, she is not paying any of the marital debt as she says she as no money. will this go against her when we go to court to sort out the finances. she says her new live in partner is paying for it. her standard of living is the same or better than when we were together, if i can prove it and make it look like she is a gold digger will it go in mine and the kids favour

What stage of proceedings are you at? Have you applied for or got your Nisi yet? Are you planning to apply for Ancillary Relief? Or are you just looking to sort out financials?

In answer to your post, keep a diary and document evry single incident of you asking her for money, every incident of her spending money that should be coming to you and your children.

Yes, all of the things you talk about will go against her. What is important is to have a list of every example of her financial irresponsibility, ready to present.

If you do get the nisi and apply for ancillary relief, you can apply for an interim order for maintenance, which will help you out in the short term.

I know you have had a dreadful time over the last few months, and I hope it starts to go your way soon.

i'm sure the judge is writing things down about my ex , no child support money for 18 months , but spent out 4k on IVF, holiday to Australia , fitted kitchen for her, all her debts paid off,lie detector test,hypnosis sessions for her,over 2k on flowers for her, wedding booked in Mauritus.The list goes on and on.

Your kids Mr x bugger all from ya don't make very good reading does it .

So Soul hopefully our kids will get what they deserve from the other parent.

my nisi is going through and i am seeing my sol on tuesday to sign my form E. i tried to sort finances out 12 months ago and was told by her sol that it was in my best interest to pay the debt. i am asking for the money outstanding that she hasnt paid. if it goes in my favour i will get the lot as the outstanding money is higher than she would have got from a settlement and then there is the sol costs which i want her to pay and i will ask for AR all this is my new starting point (i have moved the goalposts a very long way)

Sounds like things are finally heading in the right direction for you. The courts take a very dim view of people 'concealing' assets or income, and if you have documented lots of stuff and have some really hard questions from her form E, she is in for a grilling I would think. Keep us posted on how it goes soulman!
