Been to court 3 times in Jan, over emergency relief and children, first 1 he didnt show 4, next hearing in march, he has been filing his form E for 6 months voluntarily, now he has to for court but strangly enough still hasnt, I know he is trying to move money about and get rid of things im really quite afraid of me and 3 younge children being left with very little to survive, seems he is talking out loans to build his debt and got an expensive solicitor to add to them as well, all the time im trying to not spend money... any help pls...:S

I can appreciate where you are coming from. I am in court tomorrow over finances and children. My x2b swore his Form E at court as a full and frank disclosure, never heard such lies.

My x2b has also run up large debts in the 6 months since he left. He has also stopped paying me CM which is nearly £600 a month, but the court has no ability to make him pay this amount. I am now in arrears with the mortgage.

I have 5 children under the age of 12 years old and have no money, whilst he swans into court with a posh new suit and an expensive barrister (which then costs me to get a barrister too), this being for an injunction hearing last week.

We sent him a questionairre re the big holes in his Form E and as yet we have not had a reply. We have not received a questionairre in response to my Form E, and although it was a full and frank disclosure we did expect him to pick holes in it.

My solicitor now thinks he hasn't paid his solicitor bills and that is the reason. She thinks the First Appointment will be adjourned and that he will argue the house valuation as well (which is pointless) just more time and money that I haven't got. The longer this goes on, the more likely I am to lose the house; but does he care?

He doesn't see the children at the moment, his choice and the judge wants to speak to us tomorrow about the issue of contact.

Can see the financial hearing being a complete waste of time.

If you have any evidence of what your x2b is doing then you need to keep it. Is he paying any of your bills or mortgage, paying you child maintenance?

You have a chance to ask questions about his Form E before you go to court, you should have recieved a Form C - Notice of a First Appointment, which sets out dates as to when things need filing, like the questionairre. I take it you have a solicitor?

If he does not file his Form E on the said date, it certainly will not look good on him (says he has something to hide). I will post again when I have had my fist appointment tomorrow to tell you what actually happened, although not a lot I suspect.

I had no idea when I entered into this that it could all take so long or how unbelievable others behaviour can be esp when you have been married to them for years and years.

I would really love to hear how you get on as I have my first date in court coming up in April and hope against hope it doesnt drag on and on.

I had no idea when I entered into this that it could all take so long or how unbelievable others behaviour can be esp when you have been married to them for years and years.

I would really love to hear how you get on as I have my first date in court coming up in April and hope against hope it doesnt drag on and on.

Thanks Sarah, It seems they are all from the same mould...
although i took him to court for imterim maintenance and that is now in an order so he cant get away without paying it, someone told me take everything through court or they wont pay when ther time comes. He is paying the mortgage thankfully and has to also continue that in the order, so at least im okay for the time being on that score.
I have 3 kids and he took me to court over contact fighting me for custody but the cafcass report was in my favor and he now gets 1 night a week, with every other weekend. i was just reading the form e shouldbe filed 35 days in advance of the hearing well we are down to about 25 days now and still nothing, i know he is trying to hide money and get rid of stuff, also hsi solicitors want to bypass the first hearing and go stright to the 2nd even though we havent had his form yet ...lol its a joke isnt it, to top it all he bats for the other team and caused all this mess, but cant stop being a total to55er.
