I'm at my wits end. I have seen a solicitor yesterday for financial advice and am really confused now. I don't want a divorce but feel I have no choice as my husband is definitely not coming back to me, however I asked him this morning if he would consider separation and he give me maintenance for my soon to be 17 year old and 15 year old.

What I want to know is how long does a separation have to be to go to divorce where do I stand regarding maintenance. He earns plenty, enough to pay maintenance and have a good standard of living.

You are definitely due maintenance for both children if the older one is still in full-time education. Contact the csa and put in a claim. You should get 20% of net income for two children.
