What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

We have a house, joint names, huge mortgage. My wife has a small job (self employed) that would not pay anywhere near the monthly repayment. I worked out on a 50:50 split of assets she would walk away with around 400k cash plus CM.

I am going to propose that she leaves the mh, buys another property and I take over the mh. I am prepared to give her 50% of the equity and also 50% of the deposit i.e. buy her out if she wants. I want to stay as it is not only my home, but my office as I run a small business, that I set up in March this year.

My question is. As she is walking away with a fair amount of cash, can afford to buy a 3 bed place for her and the two girls, would the courts be able to force me to sell? I can afford the mortgage etc, but as I say it is also my place of work. I will also keep two beds for the children as we are seeking 50:50 custody.

Thanks
