What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I am thinking of buying my wife out of the home, she doesn't want to stay there anyhow as hates the place and I am looking to buy her out...

My questions are...

1. Would I pay stamp duty if house in both names and she signs over to me on payment of agreed amount?

2. Any other costs involved?

Thanks

No, I think there is a specific exemption from stamp duty where property is transferred pursuant to a Separation Agreement or a Court order on divorce. Apart from that there would no doubt be legal and valuation costs.
