What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Depending on your situation (sorry dont remember your other threads) he should be paying Child Support and/or Spousal Maintenance.

He could pay either voluntarily, but if he refuses to pay then you should pursue your claim:
- for child support via the CSA
- for interim spousal maintenance (pending a final agreement) through the local county court.

Until you do one of the above nothing is forcing him to pay anything - other than his moral obligation.

With 2 kids you should be getting 20 percent of his net income.
You may well also qualify for a range of benefits such as child tax credit, working tax credit, child benefit, housing bebefit - see the benefits section in the Top Sites section

You cannot apply for interim maintenance unless you have filed for divorce - you might already have done so but it isn't mentioned in this thread. But CSA applies, and a threat about that might do the trick.
