What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

I went to court re child access last week - the judge had a go at me for not having got the divorce done and dusted by now - When I told him we haven''t agreed on finances because the stbx refuses to give me details of OUR properties etc and I can''t make an informed decision, he said ''well why don''t you just get an order for goodness sake!?'' Can anyone tell me what he was talking about?

Hi Angie,

I think he may be referring to one of you starting Ancillary Relief - once this process is started, a set timetable is begun and your stbx can be ordered to provide the necessary information by the Court.

Thanks WR. I read up on this on the website - it seems a bit scarey. Would we have to go through the whole process in court then, or can I just get an order to get him to divilge his finances, and then we do out of court agreements from there? And if we can, do you know once we''ve agreed, what we have to do to make the agreement official, and no going back?

Thanks for your help!
