Hi
I have just filled form E and submitted it yesterday. My first court date is in next month. I tried several times to resolve the financial matter between me and my husband but everything I agree to what he asks for he changes his mind and asks for more share from the house. We have two properties between ourselves. One is commercial and other matrimonial house. Me and my 7 year daughter live in matrimonial house we have big mortgage and bills on that house. My ex lives with his mum as he can''t live in matrimonial house because he has court orders not to approach me he has been convicted for assaulting me in front of my daughter. He is not contributiong a single penny towards mortgage bills or towards daughter. He is on benefits as he made excuse his conviction for not getting the job. I have buyer to buy the house and they are pushing for sale to go through quickly as nothing been settled between us and first court date is in may. My solicitor saying nothing will be done on first date. Is any way I can appeal to court matter to resolve quickly beacase I have buyer for the house or what''s the other alternative for me in this situation. I have no family to go to in this country.

No there is nothing you can do the process is ridged.

The only way you can sell is if your ex agrees.

Court wise your looking at about a year before a judge will order anything unless you can both agree in the mean time.

Thanks for the reply. He has agreed to sell the house and till court decides and the money will held in solicitors hand but then me and my daughter will have no place to go to. What will be the best thing for me to Do at this point please advice.

Assuming you also want to sell all you can do is arrange that some of the money to be held on account be released for the express purpose of renting a place for you and the girl, the rental money can be paid directly from the solicitors account with their agreement.
