What are we each entitled to in our divorce settlement?

What does the law say about how to split the house, how to share pensions and other assets, and how much maintenance is payable.

What steps can we take to reach a fair agreement?

The four basic steps to reaching an agreement on divorce finances are: disclosure, getting advice, negotiating and implementing a Consent Order.

What is a Consent Order and why do we need one?

A Consent Order is a legally binding document that finalises a divorcing couple's agreement on property, pensions and other assets.

Hi All,

this is my first post.

My divorce has come through

My exwife is stalling on any discussions on the Consent Order or financial settlement. I have been trying for almost 10 months (before and after Decree Nisi) but she keeps promising to discuss or respond to the draft settlement document I sent her but she doesn''t.

We only have a few things to split (no house/mortgage) and in total is less than four thousand pounds hence why it''s more annoying that she''s playing games. We are both fully employed.

I do not trust her, hence why I want her out of my life completely for now and the future.

Due to the few assets and the fact that we don''t have children I didn''t select the option to apply for a Financial Order in my divorce petition.

What options do I now have in order to get a Consent Order?

Best regards,
Mike

If she won''t agree the CO your only option is court, this of course can be very expensive indeed, if this does happen then a judge will have the final say if through the whole process you still not agree.

To get the Consent Order or Clean Break via the court what do I need to do?

What do I need to apply for and which forms do I need to fill in?

There are guides on the site in the tool bar and library, plus I would guess many thousands of posts on the subject, you need to learn lots if you intend to do this.

The form that starts the process is form A which costs £240 unless that went up, after that you will both be asked to complete a heap of paper work starting with form E, a 28 page form for disclosure, have a look at the guides.
